Former Chief Justice Gertrude Torkonoo, has filed a legal suit to halt the vetting and potential appointment of Justice Baffoe-Bonnie as Ghana’s next Chief Justice.
In her application before the High Court, Justice Torkonoo is asking the court to quash all proceedings of the Justice Gabriel Scott Pwamang Committee, which was set up under Article 146 to investigate petitions that led to her removal from office.
She is also requesting that the court declare the Presidential Warrant authorizing her dismissal unlawful, null, and void, and to set aside all actions and findings of the said committee.
The legal challenge comes just as Parliament’s Appointments Committee prepares to vet Justice Baffoe-Bonnie for the top judicial position.
Justice Torkonoo’s suit follows her removal from office on September 1, 2025, by President John Mahama, after a constitutionally established inquiry found her guilty of misconduct and stated misbehaviour under Article 146.
The investigation, conducted in consultation with the Council of State, concluded that she had violated certain constitutional provisions, including the misuse of public funds, and subsequently recommended her dismissal.
Justice Baffoe-Bonnie, who has been Acting Chief Justice since April 22, 2025, following Torkonoo’s suspension, was formally nominated by the President in September to assume the substantive role.
